By accessing, registering for, or using Kowura, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use the Platform.

These Terms apply to all users of Kowura, including students, tutors, instructors, visitors, account holders, and other individuals who access or use the Platform.

1. About Kowura

Kowura is an online educational platform designed to connect students and tutors and provide access to educational courses, tutorials, learning materials, assessments, and related services.

Kowura may provide the technology and infrastructure through which tutors create and offer educational content and students discover, purchase, enroll in, and access courses.

Unless expressly stated otherwise, Kowura does not guarantee that any particular tutor, course, educational material, qualification, result, or learning outcome will meet your individual expectations.

2. Acceptance of These Terms

By creating an account, accessing the Platform, enrolling in a course, purchasing a course, registering as a tutor, uploading content, or otherwise using Kowura, you confirm that you have read, understood, and agree to these Terms.

If you are using Kowura on behalf of another person, organization, school, company, or other entity, you confirm that you have the authority to accept these Terms on their behalf.

We may update these Terms from time to time. Your continued use of the Platform after updated Terms are published constitutes acceptance of the updated Terms, subject to applicable law.

3. Eligibility

You must meet the minimum legal age and other eligibility requirements applicable to you in order to create and use a Kowura account.

Students must not share their account credentials with other individuals or allow unauthorized persons to access paid courses through their account.

Unless expressly permitted by Kowura or the applicable tutor, a course purchased by one student is intended for that student’s personal educational use and may not be redistributed, resold, sublicensed, copied, or shared with other people.

6. Tutor Accounts

Tutors may use Kowura to create profiles, publish courses, provide educational materials, interact with students, and offer educational services through the Platform.

Tutors are responsible for ensuring that all information they provide about themselves, their qualifications, experience, courses, and educational materials is accurate and not misleading.

Kowura may require tutors to provide additional information for identity verification, payment processing, fraud prevention, legal compliance, or other legitimate purposes.

Approval of a tutor account does not constitute an endorsement or guarantee by Kowura of the tutor’s qualifications, experience, teaching ability, or professional status.

7. Tutor Responsibilities

By offering courses or educational services through Kowura, tutors agree to:

• Provide accurate and honest information about their courses and qualifications;
• Provide educational content that is reasonably accurate and appropriate for the stated course;
• Deliver the services associated with their courses as described on the Platform;
• Respond to students and provide reasonable support where applicable;
• Respect students and other users;
• Comply with applicable laws and regulations;
• Respect intellectual property rights;
• Not upload unlawful, harmful, fraudulent, defamatory, or misleading content;
• Not use Kowura to facilitate fraud, scams, or other unlawful activity; and
• Maintain the confidentiality of student information obtained through the Platform.

Tutors must not request unnecessary sensitive personal information from students or use student information for purposes unrelated to legitimate educational or Platform activities.

8. Courses and Educational Content

Courses available on Kowura may be created and provided by independent tutors or instructors.

Course descriptions, materials, teaching methods, duration, pricing, availability, and content may vary between tutors.

While Kowura may review, moderate, or remove content where appropriate, we do not guarantee that every course or educational material will be error-free, complete, current, or suitable for every student.

Educational content available through Kowura is generally provided for informational and educational purposes. Unless expressly stated otherwise, completion of a course does not guarantee employment, admission, certification, professional licensing, academic credit, income, or any particular result.

9. Intellectual Property

Unless otherwise stated, Kowura and its licensors retain all rights, title, and interest in the Platform, including its software, design, branding, logos, website structure, text, graphics, interfaces, and other materials created or provided by Kowura.

Tutors retain ownership of their original course content and materials, subject to the licenses granted to Kowura under these Terms.

Students and other users retain ownership of original content they independently create and submit to the Platform, subject to the rights granted to Kowura that are necessary to operate the Platform.

10. Tutor License to Kowura

When a tutor uploads or submits course materials to Kowura, the tutor grants Kowura a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, distribute, and otherwise use that content as reasonably necessary to operate, promote, improve, and provide the Platform and the course services.

This license continues for as long as reasonably necessary to provide the relevant services and to comply with legal, security, backup, and record-keeping requirements.

Tutors represent that they have the necessary rights and permissions to upload and use the content they submit to Kowura.

11. Prohibited Content

You must not upload, publish, distribute, or otherwise use Kowura to provide content that:

• Violates applicable laws or regulations;
• Infringes copyright, trademarks, patents, or other intellectual property rights;
• Contains malware, viruses, malicious code, or harmful software;
• Is fraudulent, deceptive, or intentionally misleading;
• Defames or unlawfully harasses another person;
• Contains unlawful or exploitative sexual content;
• Promotes violence, terrorism, or serious criminal activity;
• Discloses another person’s private or confidential information without authorization;
• Attempts to obtain passwords, financial information, or other sensitive information improperly;
• Is designed to spam, manipulate, or abuse the Platform;
• Impersonates another person or organization; or
• Otherwise violates these Terms or our policies.

12. Student and Tutor Conduct

All users are expected to interact with each other respectfully and professionally.

You must not use Kowura to:

• Harass, threaten, intimidate, or abuse another user;
• Attempt to manipulate course ratings, reviews, or feedback;
• Defraud students, tutors, or Kowura;
• Attempt to bypass Kowura’s payment systems where doing so violates Platform rules;
• Collect or misuse another user’s personal information;
• Attempt to gain unauthorized access to accounts or systems;
• Interfere with the operation of the Platform;
• Use automated systems to scrape, copy, or excessively access the Platform without permission;
• Distribute paid course content without authorization; or
• Use the Platform for unlawful purposes.

13. Payments

Kowura may allow students to purchase courses and other educational services through the Platform.

Payments may be processed through third-party payment providers such as Stripe. By making a payment, you agree to provide accurate payment and billing information and authorize the applicable payment provider to process the transaction.

Prices may be displayed in the currency indicated on the Platform and may be subject to applicable taxes, fees, or other charges.

Kowura may change course prices or other charges from time to time. Price changes will generally not affect transactions that have already been completed, except where required by law or expressly stated otherwise.

14. Refunds and Cancellations

Refunds, cancellations, and course withdrawal requests may be subject to the refund policy displayed on the relevant course, the terms presented at checkout, or a separate Kowura refund policy.

Where no specific refund policy is provided, refund requests will be considered on a case-by-case basis and in accordance with applicable consumer-protection laws.

Nothing in these Terms is intended to remove or limit any mandatory consumer rights that cannot legally be excluded.

15. Tutor Payouts and Platform Fees

Where tutors are permitted to earn money through courses offered on Kowura, applicable platform fees, commissions, payment-processing fees, taxes, or other charges may be deducted before funds are paid to the tutor.

The applicable revenue-sharing arrangement or fee structure may be communicated to tutors through the Platform, tutor documentation, onboarding information, or other applicable agreement.

Kowura may delay, suspend, or withhold a payout where reasonably necessary to investigate suspected fraud, payment disputes, chargebacks, policy violations, account issues, or legal requirements.

Tutors are responsible for any taxes, reporting obligations, or other financial obligations arising from income received through the Platform unless applicable law provides otherwise.

16. Chargebacks and Payment Disputes

If you believe a payment was made incorrectly, you should contact Kowura before initiating a payment dispute where reasonably possible.

We may investigate disputed transactions and provide relevant information to our payment processors where necessary to respond to chargebacks, fraud claims, or payment disputes.

Fraudulent or abusive chargebacks may result in suspension or termination of the associated account, subject to applicable law.

17. Reviews and Ratings

Where reviews or ratings are available, users must provide honest and genuine feedback based on their actual experience.

You must not submit fake reviews, reviews on behalf of another person, reviews intended to manipulate ratings, or reviews that contain unlawful or abusive content.

Kowura may remove or moderate reviews that violate these Terms or applicable policies.

18. Communications Between Users

Kowura may provide tools that allow students and tutors to communicate.

Users must use these communication features responsibly and only for legitimate educational or Platform-related purposes.

You must not use Kowura’s communication systems to send spam, scams, unsolicited advertisements, abusive messages, malicious links, or other prohibited content.

Where reasonably necessary for security, moderation, fraud prevention, or compliance purposes, communications transmitted through Platform features may be subject to monitoring or review in accordance with applicable law and our Privacy Policy.

19. Third-Party Services

Kowura may integrate with third-party services, including payment providers, authentication services, security tools, analytics services, video providers, email services, and other technology providers.

Your use of third-party services may be subject to those providers’ separate terms and privacy policies.

Kowura is not responsible for the availability, functionality, security, or policies of third-party services that we do not control.

20. Availability of the Platform

We aim to keep Kowura available and operational, but we do not guarantee that the Platform will always be available, uninterrupted, secure, or error-free.

The Platform may occasionally be unavailable because of maintenance, updates, technical problems, security incidents, third-party service interruptions, internet failures, or circumstances beyond our reasonable control.

We may modify, suspend, or discontinue any part of the Platform at any time where reasonably necessary.

21. Educational Disclaimer

Kowura provides access to educational and tutorial content but does not guarantee any specific educational, professional, financial, employment, examination, academic, or career outcome.

Students are responsible for evaluating whether a course is appropriate for their needs and circumstances.

Information provided through courses should not automatically be treated as professional legal, medical, financial, investment, or other specialized advice unless the relevant service is expressly provided as such by a properly qualified professional.

22. Limitation of Liability

To the maximum extent permitted by applicable law, Kowura will not be responsible for indirect, incidental, special, consequential, or punitive losses arising from your use of the Platform.

This may include loss of profits, revenue, business opportunities, data, reputation, or other intangible losses.

We are not responsible for the actions, omissions, qualifications, representations, or conduct of individual tutors or students, except to the extent that applicable law provides otherwise.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

23. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Kowura, its operators, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from:

• Your violation of these Terms;
• Your unlawful use of the Platform;
• Your infringement of another person’s intellectual property or other rights;
• Content you upload or submit to the Platform; or
• Your misuse of the Platform or another user’s information.

24. Account Suspension and Termination

We may suspend, restrict, or terminate an account where we reasonably believe that the user has:

• Violated these Terms;
• Engaged in fraud or other unlawful activity;
• Misused the Platform;
• Created a security or safety risk;
• Infringed another person’s rights;
• Attempted to manipulate payments or payouts; or
• Otherwise engaged in conduct that may harm Kowura, its users, or the integrity of the Platform.

Where appropriate and legally required, we may provide notice and an opportunity to address the issue before taking action.

Termination or suspension does not automatically eliminate obligations that arose before the account was suspended or terminated.

Any dispute arising from or relating to your use of Kowura will be handled in accordance with the applicable laws and jurisdiction, subject to any mandatory consumer or other legal protections that apply.

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable, where legally permitted.

The remaining provisions of these Terms will continue to remain in effect.
